TERMS OF SALE

1 – Purpose and scope These Terms of Sale (“Terms”) govern all sales of digital products made on lingoxing.com between the publisher (“the Seller”) and any person making a purchase (“the Customer”). Placing an order implies full and unreserved acceptance of these Terms. The Seller may modify them at any time; the Terms applicable are those in force at the time the order is validated. They are accessible at all times via a footer link and prevail over any other document.

2 – Products The Seller offers digital products for learning Chinese (vocabulary flashcards, character-writing worksheets and other learning materials), supplied as downloadable files (notably in PDF format). The products are intended for the Customer’s strictly personal use. Any resale, sharing or redistribution is prohibited.

3 – Prices Prices are shown in euros, all taxes included. VAT not applicable, article 293 B of the French General Tax Code (VAT exemption). As the products are exclusively digital, no delivery charges apply. Products are billed at the rate in force when the order is validated.

4 – Orders An order is validated once the Customer ticks the box “I have read and accept the Terms of Sale” (box not pre-ticked) and proceeds to payment. A confirmation is then sent by e-mail. The Seller may refuse or cancel any order for legitimate reason or suspected fraud.

5 – Payment Payment is made online by bank card or by any other payment method offered at checkout. Transactions are secured by the payment provider Stripe; the Seller has no access to any full bank-card data. Orders are processed only after payment is confirmed.

6 – Delivery (digital) As the products are exclusively digital, no physical delivery takes place. Once payment is confirmed, the Customer receives, by e-mail and/or from their order account, a link to download the purchased file(s). It is the Customer’s responsibility to save their files. The equipment and connection required for downloading are the Customer’s responsibility.

7 – Right of withdrawal and its exclusion for digital content In accordance with article L221-18 of the French Consumer Code, consumers normally have a fourteen (14) day withdrawal period. However, under article L221-28 of the French Consumer Code, this right cannot be exercised for digital content not supplied on a tangible medium where performance has begun after the Customer’s prior express consent and express waiver of the right of withdrawal. Accordingly, when placing an order, the Customer expressly requests immediate access to the download upon payment validation and expressly acknowledges losing the right of withdrawal once the download is made available. This consent is collected via a dedicated, non-pre-ticked checkbox. Failing this, the 14-day period remains applicable.

8 – Legal guarantees The consumer Customer benefits from the legal guarantee of conformity for digital content and services (articles L224-25-1 et seq. of the French Consumer Code) and the legal guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). In the event of a defective, unreadable or non-conforming file, the Customer may contact the Seller at contact@lingoxing.com to obtain a correction, replacement or refund.

9 – Liability and intellectual property The products are protected by copyright. A purchase grants a personal, non-exclusive right of use; reselling, sharing, distributing or reproducing the files, in whole or in part, is prohibited. The Seller cannot be held liable for the Customer’s learning results or for any technical failure of the Customer’s equipment.

10 – Complaints For any complaint regarding an order or a product, the Customer may contact the Seller by e-mail at: contact@lingoxing.com. The Seller undertakes to handle any complaint as promptly as possible and to seek an amicable solution.

11 – Personal data The processing of personal data is described in the website’s Privacy Policy.

12 – Governing law These Terms are governed by French law. Failing an amicable resolution, the French courts have jurisdiction.
